ECOWAS court dismisses all claims against Ghana in Gertrude Torkornoo case

The Deputy Attorney General and Minister for Justice, Justice Srem-Sai, has announced that the ECOWAS Community Court of Justice has dismissed all seven claims filed against the Republic of Ghana by former Chief Justice Gertrude Sackey Torkornoo.
In a statement shared on social media on Wednesday, June 24, 2026, Justice Srem-Sai confirmed that the regional court ruled in favour of Ghana, rejecting all allegations that the former chief justice's rights were violated during the proceedings leading to her removal from office.
“The ECOWAS Community Court has, a while ago, dismissed all of the seven claims which the former Chief Justice, Her Ladyship Justice Gertrude Torkornoo, brought against our beloved Republic,” he stated.

According to him, the court also dismissed the claim for US$10 million in damages, which had been sought as compensation for alleged human rights violations.
“In respect of Her Ladyship’s claim for US$10 million in damages, the Court held that in light of its conclusions that Ghana has not violated any of the Applicant’s rights under the African Charter, the Court makes no decision on reparations,” he added.
Justice Srem-Sai commended Ghana’s legal team for their role in defending the state throughout the proceedings.
The ruling marks a significant development in the legal dispute between the former Chief Justice and the Republic of Ghana. Justice Torkornoo had filed the case at the ECOWAS Court challenging the constitutional process that led to her removal, alleging violations of her rights under the African Charter on Human and Peoples’ Rights.

Her claims included allegations of invasive searches, restricted access to family members during hearings, and the seizure of personal electronic devices during investigative proceedings.
Justice Torkornoo was suspended in March 2025 following a prima facie determination by a committee investigating petitions for her removal and was subsequently removed from office in May 2025 after parliamentary approval—making her the first Chief Justice in Ghana’s constitutional history to be removed from office.
The ECOWAS Court’s dismissal of all claims effectively ends the regional legal challenge and represents a significant victory for the Republic of Ghana.
